<br />~ <br />f <br /> <br />MINUTES OF MOORESVILLE PLAN COMMISSION <br /> <br />'-/ <br /> <br />The Mooresville Plan Commission met in regular session <br />on Monday, November 20, 1972. Those members present were <br />Mr. Rich Keller, Mr. Bart Hensley, Mr. Dutch Fulk, and Mr. <br />Henry Gajderowicz. <br /> <br />In absence of the chairman, William Harris, Mr. Richard <br />Keller presided. The minutes of the meeting were recorded <br />by the Board's attorney by reason of the absence of the <br />Board's Secretary. <br /> <br />There was no old business to come before the Board. <br /> <br />Attorney Lawson had indicated he had prepared new forms <br />to be used by both the Mooresville Plan Commission and the <br />Mooresville Board of Zoning Appeals. It was decided that <br />the forms should be discussed at the next meeting by reason <br />of the absence of Mr. Harris, Mr. Edwards and Mrs. Henderson. <br /> <br />'-' <br /> <br />The Board discussed the present zoning for the Smither- <br />man Building which is to be converted to a nursing home. It <br />was the Board's understanding that a building permit had not <br />been secured. In reviewing the zoning regulations and the <br />use map it was determined that the presemt zoning classifi- <br />cation is "Local Business." Further, the present zoning <br />will require a district of "general business" or in the al- <br />ternative the owners would have to seek a variance before the <br />Board of Zoning Appeals. The nursing home would fall in the <br />category of a "contingent use" pursuant to Section 17 of the <br />"Zoning Regulations of Mooresville, Indiana, 1972", the Board's <br />attorney, Mr. David E. Lawson, advised the Board that he under- <br />stood from the Clerk-Treasurer of the Town of Mooresville, that <br />Mr. Jack Smitherman had made inquiry to Town Hall relative to <br />the proper zoning needed. <br /> <br />A motion was made by Mr. Rich Keller and seconded by Mr. <br />Dutch Fulk that the Board's attorney direct a letter to Mr. <br />Jack Smitherman pointing out to him that the site was not <br />properly zoned for the contemplated nursing home and that he <br />be directed to cease and desist in continuing construcbion <br />until such time as proper~ning is applied for and granted. <br /> <br />There being no further business to come before the <br />Board, on motion of Mr. Dutch Fulk seconded by Mr. Bart <br />Hensley the meeting was adjourned. <br /> <br /> <br />tId. ~'oiding <br /> <br />'-' <br />
