MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> <br /> Pursuant to IC 36-7-4-918.5 the Mooresville Board of Zoning Appeals having heard the <br />variance filed by TKC Properties, Fred L. Fisher, Ken L. Fisher and Jack L. Perry on the real <br />property described as Lot 4A and Block 4 in Southbridge PUD and Lot I, 2 and 3 in <br />southbridge Minor Plat recorded Book 400, Page 507 and Book 401, Page 521 in the Office of <br />the Recorder, requesting a variance from development standards in sign set back, square footage <br />of signs and height of six (6) separate free standing signs; the Board now makes the following <br />Finding of Fact pursuant to IC 36-7-4-918.5: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals, and general <br />welfare of the community for the following reasons: this area is large enough and free standing <br />enough as to not to have an impact on the health, safety, morals or general welfare. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner; for the reasons that: location of the variance <br />will not affect the adjoining properties. <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance will result in practical <br />difficulties in the use of the property. However, the Zoning Ordinance may establish a stricter <br />standard than the "practical difficulties" standard prescribed by this subdivision. The actual <br />practical difficulties found to exist here are as follows: the shape of the property and location <br />adjoining the flood plane create practical difficulties. <br /> <br />Granting of the following variances: <br /> <br /> 1. A grant of a variance from the development standards in sign set back as follows: <br />from 60' to 20' on the shopping center's sign; from 20' to 10' on sign P30 and from 60' to 10' <br />on sign P70 per attached drawings. <br /> <br />2. A variance from development standards as to square footage allowing a 620' sign <br /> <br />3. Granting a height variance from a maximum of 35' to 40' on main sign structure. <br /> <br />Stipulations to run with variance <br /> <br />None <br /> <br /> <br />
