l

Mr. Holloway answered that was terminated with the sale of this property. Phil
Whiteland, 5284 St. Road 144 spoke in opposition to the the plat saying this property is
across from his main entrance, he thought property values would go down, and the owner
is an absentee owner and the house is empty most of the time. The driveway is one and
one-half feet from his property line which he thought was too close. Tom Rigdon asked
what the setback on the house would be and Mr. Holloway answered forty feet setback
which puts the house in line with the house now there. No motion was forthcoming so
this request was tabled to October 25,2001 meeting of the Plan Commission.

Ross Holloway of Holloway & Assoc. presented a request for Marsh Foods located at
435 South Center Road. The petition to Mooresville Town Center Sec. 4 PUD is to
create Lot 3A where the kiosk is located for purposes of refinancing. Mr. Holloway told
the commission the lender did not want to include the gas station. Lot 3A would be .92
acres and would not reduce the foodstore parking lot. Attorney Tim Currens said this
does not change any of their usage, just splits out the kiosk. Motion was made by
Commission Bruner, second by Commissioner Pygman to approve the amendment to the
PUD as presented. Motion carried 8-0.

Commissioner Bruner reported to the commission he had received a phone call requiring
information about the water tower on Landersdale Road, built in a new section of Collett
Acres. He had found out a permit was obtained. Ross Holloway told the commission
that the Preliminary Plat was approved for Section 3 Collett Acres and it showed that lot
dedicated for public use. Commissioner Bruner also reported no change at 40 West Main
Street.

Commissioner Beebe said he had received a letter from a resident asking if there were
regulations about placing trash dumpsters in residential areas(80 Circle Drive). Town
attomey Tim Currens said he would have Joe Beikman, Building Inspector, look at this
and report back at the next meeting.

There was no report on permits and inspections as Building Inspector Joe Beikman was
absent from the meeting.

It was decided to put on the October Meeting agenda to set the November and December
meetings. They will have to be changed due to the holidays.

There being no further business to come before the commission at this
Commissioner Young moved to adjourn.

A~~
/ ,~
Secretary
