restrictions with wording to include vinyl covered chain length fence and posts are
permitted. Motion carried 8-0 with Commissioner Crouch abstaining.

Next, Ross Holloway presented an amendment to the Wright Family PUD on State Road
144 next to Spring Hill Christian Church. These are the six doubles originally built by
Reverend Wright. Spring Hill Christian Ministries are the current owners and are selling
to James Wheeler. For financing purposes this lot #2 needs to be divided into six lots, a
double on each lot. The original PUD was approved April 1, 1996. Town attorney Tim
Currens told the commission the County Recorder was right on top of this when they
tried to record the deed and told them they would have to appear before the Mooresville
Plan Commission for an amendment. Mr. Holloway told the commission Lots 2A, B, C,
D, E, and F would share equally on maintenance of the road and he said he could add a
clause for a cross parking easement. Motion was made by Commissioner Crouch, second
by Commissioner Williamson to approve amendment with road maintenance and cross
parking clause language as discussed. Motion carried 9-0.

Ross Holloway presented a rezone request from Ward's Apparel from B-2 to B-3. He
told the commission there was some confusion as to whether this entire parcel was B-2 or
B-3. He wants to rezone entire parcel to B-3. Motion was made by Commissioner
Williamson., second by Commissioner Ehrhart to recommend to the Town Council to
approve a B-3 zoning for entire parcel. Motion carried 9-0. This will be heard at the
January 8, 2002, Town Council meeting.

~

Next, Ross Holloway, representing the Town of Mooresville, requesting a 2 lot minor
plat at the Carter-Lee PUD, Butier-Krivoshia property. Carter Lee is donating .981 acres
out of the southeast corner to Town .of Mooresville for a Fire Station. The way the lot is,
a 40 foot instead of 50 foot setback is all that can be done. Mr. Holloway said Town of
Mooresville would have to go back to Carter Lee and ask if they could donate 10 more
feet or since this was a PUD and the Plan Commission could be flexible on the setback,
he would be back next month with a site plan. Motion was made by Commissioner
Young, second by Commissioner Crouch to state the Plan Commission could be flexible
on the building line setback based on the fact this is a PUD and in the near future a site
plan would be presented. Motion carried 9-0.

Ross Hol1oway representing Paul Anderson, 369 Greencastie Road, requested a 3 Lot
Minor Plat. Sixteen .454 acres is where existing house and barn is located. Lot 2 and 3
would be one acre each and would be proposed building sites. One of Paul's sons will
build on one of the lots. Hill water is already there. A 35 by 50 access easement would
be a share and share alike situation. Motion was made by Commissioner Ehrhart, second
by Commissioner Bruner to accept subject to share and share alike access easement and
septic permits. Motion carried 9-0.

Building Inspector Joe Beikman reported twenty-nine (29) permits and eighty-six (86)
inspections.

~
