MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> <br /> Pursuant to IC 36-7-4-918.5 the Mooresville Board of Zoning Appeals having heard the <br />variance filed by Oreq and Linda Iacobucci. 454 Bunker Hill Rd. <br /> <br />requesting the following variance from development standards re,Blest for variance <br />from reduce~ front and rear set backs, rear set back from 30' to 12', <br /> <br />now makes the following Finding of Fact pursuant to IC 36-7-4-918.5: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals, and general <br />welfareofthecommunityforthefollowingreasons: due to the shape of the lot and <br />the lcx~.mtion of th~= rr-~rt thoro ~h~.lr] ~ nc~ in~c~-~crl- <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner; for the reasons that: <br />due to the locationr size of the pror~rty there should be no i~act <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance will result in practical <br />difficulties in the use of the property. However, the Zoning Ordinance may establish a stricter <br />standard than the "practical difficulties" standard prescribed by this subdivision.
