<br />There being no questions from the audience or board, Mr. Young asked for a motion to approve <br />or disapprove the rezone from R-I to B-1. Motion was made by Commissioner McGuire, <br />second by Commissioner Bruner, to recommend to the Town Council approve the rezone from <br />R-I to B-1 for Lot 4, Block 25. Motion carried 8-0. <br /> <br />Mr. Currens said this would go to the next Town Council meeting for approval. <br /> <br />Next was Ross Holloway, Holloway & Associates, representing Diana Krueger, 10640 Holland <br />Drive, requesting a two lot minor plat. Mr. Holloway said this is in Poplar Grove Lake Estates <br />off of Orchard Road. He passed copies of the proposed minor plat and had two other things to <br />bring up. One was they have a soil evaluation report from the Board of Health saying that it is <br />acceptable for a septic system and the other is a copy of the recorded survey of Poplar Grove <br />Lake Estates that has covenants and restrictions. This is a relative simple minor plat, as you can <br />see from the site map he passed out, that it was west of Five Points off of Orchard Road which <br />was a five acre tract minor plat. Some of the restrictions are the minimum size home is 1600 <br />square feet, must be on a block foundation, no slab homes allowed, asphalt shingles on the roof, <br />maintenance of the access drive off of Orchard Road is to be shared, and it also said that the <br />parcel may be divided to create two building sites, which is what they are doing. It also talks <br />about the maintenance of the lake, which is to be shared, and this is a lake lot situation. They <br />have made reference to that on their Covenant and restrictions and the dedication, and this plat <br />will be held to those. There were several deficiencies on the plat and they have made some <br />corrections. They have added building set back lines for both lots to forty (40) feet, added the <br />length of plat turned in, one being it didn't give the deed book or the survey record book where <br />the covenants and restrictions were, and also made some annotation changes on the lead in <br />distances of the plat itself. Lot two is the new lot, lot one has the existing house on it and Mr. <br />Krueger is moving out of state. His son would like to remain in Central Indiana and he hopes to <br />build a house on lot two. They made provisions for the shared maintenance of access easement <br />off of Holland Drive South, which already has a maintenance agreement recorded with covenant <br />and restrictions of the Poplar Grove Lake Estate of which this plat is made a party. This site is <br />served by public water. <br /> <br />Mr. Young asked if there were any questions from the board. Commissioner McGuire stated that <br />this had come up before, that a lot as described in the plan is any parcel of land must abut the <br />street and this lot does not. Mr. Currens said that on a minor plat the subdivider shall not have a <br />common drive unless the covenant for maintenance is filed with the plat and recorded with the <br />plat approval. Mr. Holloway said this is a shared driveway which is part of the plat approval and <br />the maintenance agreement will be on the minor plat. He said the board has discussed this in the <br />past and the board likes the streets to be twenty (20) feet wide with eight (8) inches of stone. <br />Holland Drive is only sixteen (16) feet wide, paved with asphalt and in good shape. <br /> <br />Motion was made by Commissioner Crouch, second by Commissioner Bruner, to approve the <br />two lot minor plat at 10640 Holland Drive. Mr. Currens said for the record that on a minor plat <br />you are making a determination whether the minor plat meets the ordinance requirements, so it is <br />not approving or denying if it meets the ordinance requirements there is no discretionary <br />function here, so that is how it should be addressed. Motion carried 5-3. <br />
