is the one who issues the addresses. If we do not have any record of him issuing an address, they
have put their own address on the mailbox. This would confirm that they are using it as a duplex
and either way this is out of compliance. He feels they should come before the proper board and
ask for a non-conforming use. Mr. Currens said they would need to come before the BZA and
ask for a variance of use or a rezone. He said a non-conforming use is nothing more than a use
that existed prior to the ordinance taking effect, so we can't take it away. But if they don't use it
as he suggested for twelve months, then it goes away and cannot be re-granted. We would need
to put them on notice that we believe they are in violation and why, through the office of the
building inspector. Commissioner Young asked Mr. Beikman to send them a notice.

Commissioner Ehrhart asked if the business that was in operation on Indianapolis Road and St.
Clair St. had been approved for a business, there seems to be more signage and not a lot of
parking space. Commissioner Young said that the board had addressed it and said it was
favorable for them to stay in business. They had told the board that there would only be a couple
of cars and they were only open on weekends. Mr. Beikman said they had gone before the BZA
and gotten a variance to operate the business.

Commissioner McGuire said there was an updated copy of the Comprehensive Plan in front of
each member of the board. Mrs. Edwards has put all in corrections in that they had given her
from last month. On reading it Mr. Bruner found a couple of name changes, like the County
Hospitals, and they will have to get those updated. Mr. Bryant is to get with the school
Superintendent to update the school data and also has the water company data. He asked the
Council once this is taken care of what would the next step be. Mr. Currens said the next step
would be for the board to review it and say they like this final draft and advertise it for a public
hearing. Then pass it on to the Town Council after the public hearing for approval as an
amendment to the zoning ordinance. Chairman Young said they would read the Comprehensive
Plan and at the next meeting if there are any changes they can make them. Mr. Currens said with
the updated version, even though they do not have a final draft, they can read any changes into it
and proceed from there. Mrs. Edwards has asked Mr. Beikman to take some pictures for the
front of the plan. Mr. McGuire said she would like to take pictures of some of the businesses in
town.

Mr. Beikman reported there were 22 permits and 116 inspections last month.

There being no further business, a motion was made by Commissioner Bruner, second by
Commissioner Crouch, to adjoum. Motion carried 8-0.

The next meeting of the Plan Commission will be June 2
Town Hall.

ATTEST:

('~)'Y\,~

Secretary
