The commission would not <br />change their vote. <br /> <br />Brad Ott, Main Street Consulting, appeared before the commission requesting a <br />correction to the Walton Minor Plat that had previously been approved by the Plan <br />Commission. The correction is needed to adjust the dimensions of the two lots. <br />Commissioner Bruner asked Mr. Ott if he was moving from one side of the fence to the <br />other side and Mr. Ott said yes. Motion was made by Commissioner Bruner, second by <br />Commissioner Bryant to approve the changes. Motion carried 6-0. <br /> <br />Next, Ernie Adams appeared before the commission to voice concerns about the <br />Settlement in Heartland Crossing. He said he built three years ago and built a custom <br />home because this section was to be marketed as all custom homes. But now Hansen & <br />Horn was crossing over into this section and building less than custom homes. He told <br />the commission the marketing plan and the docs in Martinsville did not agree. Mr. <br />Adams is part of a group appealing to the Plan Commission to get some kind of control. <br />At a meeting last summer with Tim Shrout, he said Hansen and Horn was going to <br />comply with the custom homes. Chairman Young said he was disappointed because Tim <br />Shrout said this and the group meeting with him did not get this in writing, he is not <br />putting in what he said he would. Some houses are on a slab. Ernie Adams told the <br />commission that Avon would not O. K. Hansen and Horn to build. He said Hendricks <br />County hung him to what they wanted. Mr. Adams says there is a lack of enforcement in <br />the Settlement. The PUD was approved by the County but now it is in the Town of <br />Mooresville's buffer zone. Mr. Adams said this has gotten ugly and it is going to get <br />uglier. Chairman Young asked isn't the Building Inspector our eyes to see things are <br />done correctly. Attorney Tim Currens said that generally how the covenants are written <br />stands before the building inspector's reports. Mr. Currens said when the Town extended <br />it's buffer zone it had to take it as it was, the zoning can't be changed because that is <br />taking their property, it is their constitutional right. One sentence in the covenants states <br />the developer can do whatever he wants to do even though the signage says Custom <br />Homes. The question was asked, when a building permit is filed, whose job is it to <br />inspect? Our Building Inspector checks off against the covenants. Mr. Adams will take <br />the covenants to Tim Currens to read. <br /> <br />Chris Underwood appeared before the commission to ask about zoning requirements. He <br />said he was looking to buy some ground and put in five-acre tracts. Attorney Tim <br />Currens told him if he subdivided he had to have plat approval and would have to meet <br />road requirements. Mr. Currens told him to get a copy of the Town's zoning ordinance <br />and read the sub division part as it exists today. Mr. Underwood asked if that part would <br />be changing. Mr. Currens told him the Comprehensive Plan would not change the sub- <br />division control ordinance. <br /> <br />Commissioner Bruner submitted a letter of changes for the Comprehensive Plan for <br />review and wanted the members to bring back suggestions to the July meeting.
