<br />Steven Litz, representing Donald Fischer, DDS, had a request for a rezone of 118 North <br />Indiana Street from R-I/B-2 to B- 1. Mr. Fischer needs more parking for his dental <br />practice. Attorney Currens told Mr. Litz zonings were not split, so probably there was a <br />variance at some point and time. Mr. Fischer wants to use the back third of the property <br />for parking and is leaving the house for now. He could not rent to residents but could to a <br />business within the B-1 zoning. A motion was made by Commissioner Bryant with a <br />second from Commissioner Bruner to give a favorable recommendation to the Town <br />Council to approve the rezone. Motion carried 6-2 with Commissioners Corbin and <br />McGuire opposed. This will be heard at the September 7,2004 Town Council meeting. <br /> <br />Next, Ross Holloway explained that the Grace Missionary Church located on Highway <br />67 and Allison Road needed to expand and had entered into a transaction with Yeager <br />Sugarwood LLC. The church has six acres now and will build on the twenty-four acres <br />across Allison Road. The property the church is currently on is zoned agriculture and <br />requests a B-3 zoning. They were also requesting the twenty-four acres be rezoned to B- <br />I. Commissioner McGuire asked what was going on in the B-3 zoning. Mr. Holloway <br />said the owners do not mind a restriction for a dance club. He also said that probably <br />Town Center Road would someday go thru the Jones property to connect with this <br />property. <br /> <br />Mr. Bohanoon, 135 Duncan Court, told the commission he thought a church was the best <br />use for the twenty-four acres. Mike Griffith, 13616 North Duncan Drive commented his <br />property backs up to the proposed church property and his only question was the twenty- <br />foot utility easement. Mr. Holloway said part of Sugarwood Subdivision couldn't control <br />what a utility would want to do. A motion was made by Commissioner McGuire with a <br />second by Commissioner Williamson to give a favorable recommendation the Town <br />Council to rezone the current church property of six acres from Agriculture to B-3. <br />Motion carried 8-0. This will be on the agenda for the Town Council on September 7, <br />2004. <br /> <br />Commissioner McGuire asked what the reason was for a B-1 zoning on the twenty-four <br />acres because a church was also permitted in Agriculture. Mr. Holloway answered and a <br />church is permissible in B-1 and by special exception on agriculture. A motion was made <br />by Commissioner McGuire with a second by Commissioner Bruner to recommend to the <br />Town Council to ,,:/?prove the rezone. Motion carried 8-0. This will also be on the <br />agenda for Sept. 7 Town Council meeting. <br /> <br />Ross Holloway presented the revision of the plat to make one lot for Willis & Karen <br />Yeager and Sugarwood LLC. They wish to split lot 3 and create lot 4 consisting of 18.5 <br />acres south of Silon Creek. Lot 3 had contained approximately thirty-six acres. Now Lot <br />3 would contain approximately 18 acres. Lot 3 access would be from the existing <br />egresslingress Weliever Chevrole~es which is seventy foot wide. Mr. Holloway <br />said they do have to add a couple of thirigs to the plat, a building line and right of way <br />line. They will be trying to preserve for the Town some sort of drainage easement along <br />Silon Creek. Attorney Currens asked if they would be building over the new line. Mr. <br />Holloway answered yes, two issues have to be resolved, one issue is two different owners <br />
