3. The Seller agrees to pay any other miscellaneous filing fees that are necessary, to close <br />not in excess of $500. Any amount over $500 shall be bore by the purchaser. <br /> <br />Inspections: <br />1. Purchaser acknowledges that Seller has made no xvarcanties or representations <br />pertaining to the quali~' or condition of the real estate and that Purchases has inspected <br />the premises and agrees to purchase real estate in an "as is" condition provided, however, <br />Purchaser may have the premises inspected by reputable and qualified parties x~ithin 10 <br />days after the acceptance of this offer. <br /> <br />If such inspection is made and xwitten reports reveal either termite infestation or damage, <br />detects in the roof or tbundation, heating, air-conditioning, plumbing or electrical <br />systems which cannot be repaired or remedied for a total cost of $1,000 --One Thousand <br />Dollars and 00/100-- or less, Seller shall have the fight, unless condition is waived by <br />Purchaser to cancel this contract in which event the earnest money shall be promptly <br />returned to Purchaser. If repairs can be made tbr the amount stated above or less. Seller <br />shall pay such costs. <br /> <br />Defaults: <br />If Seller through no fruit of Seller, is unable to convey marketable title as required by <br />this Contract and the defect or defects are not waived by the Purchaser, Seller's sole <br />obligation shall be to return the earnest money and any money expended for survey; <br />however, Purchaser shall have the right to pay and satisfy, any existing liens not otherwise <br />assumed by Purchaser and deduct that amount t¥om the purchase price. [f Seller refuses <br />to perform as required, Purchaser may pursue all available legal and equitable remedies. <br /> <br />If Purchaser refuses to perform as required by this Contract, Seller may either elect to <br />pursue all available legal or equitable remedies or declare a tbrfeiture hereunder and <br />retain the earnest money as liquidated damages. <br /> <br />Closing: <br />1. The transaction shall be closed at a time and a place acceptable to the parties but not <br />later than June 25, 1997. Either part?,., may request and receive a 15 day extension of the <br />closing date in the event the transaction cannot be closed by the original date. <br /> <br />2.
