<br />MOORESVILLE BOARD OF ZONING APPEALS <br />FINDINGS OF FACT <br />FOR VARIANCE OF USE <br /> <br />Pursuant to IC 36-7-4-918.4, the Mooresville Board of Zoning <br />Appeals, having heard the variance filed by Jerry Brown and Judith <br />Brown, 370 W. Carlisle St. requesting the following variance of <br />use to operate a professional counseling office, now makes the <br />following Finding of Fact pursuant to IC 36-7-4-918.4: <br /> <br />1. The approval will not be injurious to the public <br />health, safety, morals, and general welfare of the community due <br />to the following: this use should be a low impact having no real <br />affect on the surrounding community <br /> <br />2. The use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner due to the following: this is a low impact use and <br />should no adverse affect on the adjoining property <br /> <br />3. The need for the variance arises from some condition <br />peculiar to the property involved, namely: the location has some <br />business uses close to it and would limit the use of this property <br />which may not be best suited for residential <br /> <br />4. The strict application of the terms of the Zoning <br />Ordinance will constitute an unnecessary hardship if applied to <br />the property for which the variance is sought; namely: due to the <br />location of the property the type of use is appropriate yet the <br />total transition of this area has not been made to allow <br />commercial <br /> <br />5.
