<br />MOORESVILLE BOARD OF ZONING APPEALS <br />FINDINGS OF FACT <br />SPECIAL EXCEPTION <br /> <br />The Board of Zoning Appeals having held a public hearing on <br />July 14, 2005, which was continued until August 11, 2005 with <br />additional evidence being heard on that date, for a Special <br />Exception for Hoosier Energy for a substation at 497 E. Bunker <br />Hill Rd. now proceeds with the following Findings of Fact <br />pursuant to Chapter 5 of the Town of Mooresville's Zoning <br />Ordinance ~Special Exception ProceduresR: <br /> <br />1. The establishment, maintenance or operation of the <br />Special Exception will not be detrimental to or endanger the <br />public health, safety, morals and general welfare of the <br />community due to adequate buffering from adjoining uses. <br /> <br />2. The Special Exception would be injurious to the use and <br />enjoyment of other properties in the immediate vicinity for the <br />purposes already permitted in that the evidence presented showed <br />that property values would be reduced by the construction of the <br />Special Exception use. <br /> <br />3. The establishment of the Special Exception would not <br />impede or substantially alter the normal and orderly development <br />and improvement of the area surrounding the property for the uses <br />permitted in the district. <br /> <br />4. Adequate utilities, access roads, drainage and other <br />necessary facilities would be provided. <br /> <br />5. Adequate measures have been or will be taken to provide <br />ingress and egress so designed as to minimize traffic congestion <br />on the public road with access to this property being adequate <br />and use being inconsequential. <br /> <br />6. This Special Exception would be located in a district <br />where such use is permitted. <br /> <br />This Special Exception approved by the Mooresvi <br />Zoning Appeals this 18th day of November, 2004. <br /> <br /> <br />Donald <br /> <br />n C.
