~

--

states a covenant for maintenance is filed with and recorded with the plat. Danny
Thomas said so this means my neighbors and I need to come to an agreement. Attorney
Currens said "yes". Commissioner Ehrhart asked if they needed to continue this request
until a maintenance agreement is obtained? Attorney Currens said the width to depth
ratio is probably O. K. Mr. Currens also said he did not have to show where setbacks
were, but they themselves needed to know to see if they have room to build. A motion
was made by Commissioner Bruner with a second by Commissioner Ehrhart to table this
request until the July 22nd meeting.

Next, Ross Holloway, Holloway Engineering, Final Plat Approval on Amberwood with
an amendment to preliminary plat approval concerning a change in roof requirements.
Commissioner Young wants 8/12 pitch, so the final plat approval was not ready for
tonight's meeting. Mr. Holloway showed pictures of homes with 5/12 pitches. He said
in Knightsbridge there was 7/12, 6/12, and maybe even 5/12 pitch. He told the
commission they were not asking for 5/12 but for 6/12 and maybe use dormers, full brick,
landscaping, and dimensional shingles. Commissioner Young said these lose their effect
on a 6/12. Mr. Holloway said he thought it a disservice to a developer to require 8/12
because of the cost of long rafters and maybe along the six lots of Knightsbridge put 8/12
and the rest 6/12. Commissioner McGuire made a motion with a second by
Commissioner Ehrhart that as a compromise they would agree to 8/12 along
Knightsbridge and a minimum of 6/12 on the rest of the homes. Motion carried 7-0.

Last on the agenda was a Mooresville Victorian Properties on West Main Street with a
request for a two lot minor plat, represented by Ross Holloway. He had asked to waive
the one- year rule of no advertising and to come back with the same plat. Lot 1 A & B
with three different levels and Lot 2. This is where the photo studio and Guidos Pizza is
located. There are cross easements. Attorney Tim Currens said this was approved once
before but the first plat was not signed so they brought it back. This will allow Guidos to
buy their share. A motion was made by Commissioner Williamson and a second by
Commissioner Crouch to approve the two lot minor plat. Motion carried 7-0.

Mr. Holloway also brought Hopkins plat, already approved, because he thought the plat
was missing a drainage easement.

Attorney Currens said that at the next meeting he would bring an amendment to
ordinance to define a nightclub in B-3 by Special Exception. Mr. Currens will publish
notice for the next meeting.

The minute's tape for 2000 on Lowe's concerning outside storage cannot be found. Mr.
Beikman asked for the 2001 minutes and tape for Nations Rent when they appeared
before the BZA.

COmmissioner McGuire asked about the cars for sale on Highway 144 across from Mr.
Holloway's subdivision. Mr. Beikman will check on this.
