February 24, 2003 <br /> <br />Mooresville Planning Commission <br />Minor Plat Hearing for Susanna Stauffer <br />Planning Commission Meeting Feb. 27, 2003 <br /> <br />Dear Commission Members, <br /> <br />I submit these comments for consideration, in my absence, to respectfully request that <br />the minor plat proposal submitted on behalf of Susanna Stauffer be denied by the <br />Commission. Said proposal does not appear to be in accordance with the objectives of <br />Moorseville's planning and subdivision control ordinances with regard to protecting <br />the health, welfare, and general well-being of the community. Attached are two <br />exhibits in support of the arguments outlined below for denying this minor plat <br />proposal. <br /> <br /> > Exhibit 1. A photocopy .of the official Morgan County plat map showing the <br /> proposed minor plat, a 5+- acre tract, along with some of the adjacent 5+- acre tracts, <br /> all of which were previously subdivided from a single farm a number of years ago. <br /> Approximate minor plat lot lines are shown in red, based on the plat drawing on file <br /> with the Mooresville Planning Commission office. <br /> <br /> > Exhibit 2. A page of photos attempting to capture the broad natural drainage plain <br /> running diagonally across the majority of one of the lots of the proposed minor plat. <br /> <br /> Specific concerns: <br /> 1. Disruption of natural drainage and water flow. One issue of great concern, visible <br /> in the Morgan County property plat photocopy and further supported by attached <br /> photos, is the very broad drainage plain or basin which diagonally crosses the majority <br /> of one of the proposed lots. When considering set back and easement lines, it is clear <br /> that a home cannot be situated on this lot without significant site improvement - major <br /> excavation, contouring, and reforming of the land in order to redirect the flow of <br /> drainage water away from improvements and the septic system absorption fields. <br /> <br /> These are actions not normally attributed to a minor plat, but to a typical subdivision <br /> under control of the Subdivision Control Ordinance which requires "site <br /> improvements" for drainage of storm water. To prevent flooding of adjacent tracts and <br /> increased erosion of neighboring properties downstream, any disturbance of the <br /> "natural water retention" properties of this site should require establishment of a <br /> retention pond or other means of controlling the rate of discharge of drainage water. <br /> <br /> 2. Suitability to septic system~/Concerns about drinking water contamination. On <br /> February 21, 2003, I spoke with a representative at the Morgan County Health <br /> Department regarding the "statement in writing" which is required from the Health ~ <br /> Department by Minor Plat Approval Procedure Ordinance (MooresVille Subdivision <br /> <br /> <br />
