<br />c <br /> <br />There is an easement agreement recorded at the county in deed record 346 page 92 for <br />maintance and up keep of the easement. Mr. Holloway stated there was a requirement <br />from the Morgan County Board of Health for a site evaluation; he asked the minor plat be <br />approved on the contingent ofthe approval from the Board of Health. There is access to <br />city water on the south side of State Road 144 and the lots are flat enough for septic <br />systems. <br /> <br />Motion to approve the minor plat contingent on the approval of the septic report was <br />made by Commissioner Bruner, second by Commissioner Young. Carried 8-0. <br /> <br />Next Mr. Ross Holloway, of Holloway and Associates, representing the Perry-Fisher <br />Group, present a petition to replat Southbridge Crossing to add a lot between lot 4D and <br />4E, North oflot 4-D is a 40-foot access and utility easement which is part oflot 4-E, that <br />is the area which will be divided, which is 1.4 acres and included the 40-foot easement. <br />They propose lot 4-E of 1.00 acres, this will eliminate the easement, and then lot 4-H will <br />be approximately .85 acres with 95 feet for frontage, They have a proposal for the new <br />lot 4-E for a NAP A Auto Store and the plans have been reworked according to the <br />specification of the Tech Review Committee. On lot 4E the building will be 6,000 sq. ft. <br />with a frontage of approximately 170 feet. There is room for one more business in lot 4, <br />but none has been proposed at this time, <br /> <br />c: <br /> <br />Motion to approve the amendment to Southbridge Crossing to add lot 4-H to the minor <br />plat was made by Commissioner Ehrhart, second by Commissioner Pygman. Motion <br />carried 8-0. <br /> <br />Next was Lance Ferrell of Banning Engineering representing Cedar Run Limited <br />requesting approval of Section 4 and 6 of the Missions at Heartland Crossing. This is a <br />continuation of the Missions section 1 thru 3 and all in infrastructure is in place. Acreage <br />for section 4 consists of 29 lots approximately 4 acres and section 6 consists of 40 lots <br />approximately 12.6 acres and all the comments from the Tech Review Committee have <br />been included. Mr. Biekman asked if there was a statement in the covenant or on the <br />plat of who would maintain the streets and Mr. Ferrell said the comment reads there will <br />be public streets with a notation that pending the out come of the lawsuit they will either <br />be maintained as private or public streets, He gave the commission a copy of a letter <br />stating the hearing will be June 21, 2001 to enter into our records. Mr. Tony Watson, <br />6450 E. CoalbluffCt. asked if the number of lots had changed from the original plat and <br />Mr. Ferrell stated there are four less lots than on the original plat. <br /> <br />Motion was made to approve Section 4 as submitted for Heartland Crossing by <br />Commissioner Bruner and second by Commissioner Crouch.
