To: Planning Commission Members <br />Date: December 9, 1998 <br />Re: Rezoning Request(s) Morgan Co. Garden Supply <br /> December 16, 1998 meeting <br /> <br />It was implied at the Nov. 17 Planning Commission meeting that all property <br />east of the garden center to Five Points was zoned agricultural, and therefore <br />the area was not considered residential. There are a lot of hoxneowners who <br />certainly challenge this overview of where they have lived and raised their <br />families the past several decades. <br /> <br />Five soil tests were taken on the property on Nov. 10, all by the same <br />person, all on the same day. This was done on perhaps the driest time of the <br />year, and when the soil would record the best results. The reports were still <br />poor, but we do not believe the results of the reports were fully explained to <br />or understood by the Planning Commission. The reports themselves state <br />that they do not, in anyway, imply to grant permit for any activity on the <br />property that doesn't already exist. <br /> <br />The decision of the Planning Commission on December 16, will determine <br />the future use of this property. If it is approved, then we must live with <br />whatever is put onto the property, and whatever effect it may have on our <br />neighborhood. It is believed that this request will be used as a future <br />stepping stone to eventually get the entire 11 acres zoned for business. Once <br />the front 4 acres are zoned for business, it will be presented to the <br />Commission that the back 7 acre portion, after all, is not really suitable for <br />residential. And, since the frontage is business, it only seems logical that the <br />back property also be rezoned. Yes this is only speculation, but we have <br />been attending these Planning Commission and Town Council meetings <br />long enough to realize how a denied request is rearranged and changed from <br />meeting to meeting and month to month to gradually confuse and wear <br />down opposition and get approvals piece by piece until the total package is <br />approved. <br /> <br /> As you know, the rezoning of this very property was denied earlier this year <br /> by both the Planning Commission and the Town Council. We are dealing <br /> with the same players, and there has been no known significant change in <br /> the original intended use for this property. <br /> <br /> <br />
