Mr. Turner <br />said he would be willing to look at a plan for straightening the road and not letting it wind <br />around the Patrick's property. Mr. O'Neal said maybe an attempt could be made for fencing or <br />mounding for headlights. Commissioner Beebe asked about sanitary capacity of C & M Utility. <br />Ron Grigsby said the cap is 94 and 80 have been set aside. He said C & M needed 9 months <br />advance notice to make the plant larger. Mr Kayes, who lives across the road from C & M said <br />water goes out in a 3 foot creek across his property. His question,"Can you dump as much as you <br />want on a person's property?" Commission's answer was 'No". <br /> <br />Commissioner Abbott said it seemed like the developers had put themselves in a box. Motion <br />was made by Commissioner Abbott, second by Commissioner Young to not approve this plat on <br />grounds it is not in best interest of public due to insufficient access to property and due to the <br />density and poor standard of design for public safety & welfare. Motion carried 6-0. <br /> <br />Next was Bookmore Lot 113 owned by Jerome Brewster, represented by Banning Engineering <br />with a request for rezone from R-1 to R-2. He wants to build an all brick double. Mr. Morgan, <br />a resident spoke to the Commission and presented a petition from the neighbors against the <br />double. The lot is 75X165, 12,375 square feet. Motion was made by Commissioner McGuire <br />second by Commissioner to recommend to the Town Council to deny this petition for rezone. <br />Motion carried 6-0. This will be heard at the May 4, 1999 Town Council meeting. <br /> <br />Next was Dale Coffey, an attorney representing Jerome Diehl. This petition was tabled from the <br />March meeting. Mr. Coffey suggested a paragraph added to the Plat to say this will be Diehl's <br />only subdivision and then Mr. Rash(adjoining land owner) can then divide his land. <br />Commissioner McGuire said the concerns of the Commission at the March meeting was they did <br />not want to get in the middle of this problem and thought Mr. Rash and Mr Diehl should go back <br />to Huntington Bank to correct the bank's error of not getting a survey completed. Commissioner <br />Young said Mr. Diehl was ready to build his home as he already had his septic in place. Mr. <br />Diehl said getting Huntington Bank back in this would take a lot more time. Town Attorney Tim <br />Currens said that under our Minor Plat no more than four parcels may be platted. If this <br />paragraph was added to the Plat this would really be correcting what Huntington Bank should <br />have done. Motion was made by Commissioner Abbott, second by Commissioner Young to <br />approve the Minor Plat because it meets the requirements of the Ordinance. Motion carried 5-1 <br />with Commissioner McGuire opposed. <br /> <br />Jeff Banning presented the Reagan Addn. rezone from R-1 to R-3 for Lots 22,23, and 24. This <br />was tabled from the March meeting. Mr. Banning stated they were requesting a lowering of <br />rezone to R-2 at this meeting. Mr. Rick Lee, nearby resident, asked if R-2 had specific size <br />requirements and set backs. He was told the R-2 height standards were the same as R-1. Each <br />lot square footage wise is: two lots at 50x132 and one lot at 38x132. Motion was made by <br />Commissioner Young, second by Commissioner Abbott to recommend to the Town Council to <br />rezone this property from R-1 to R-2. Motion carried 6-0. This will be heard at the May 4, 1999 <br />Town Council meeting. <br /> <br />The Jackson-Catellier 4 Lot Minor Plat on Hadley Road was next to be heard. Mooresville <br /> <br /> <br />
