MOORESVILLE PLAN COMMISSION <br /> MINUTES <br /> THURSDAY, MAY 27, 1999, 7;00 P. M. <br /> <br />The Mooresville Plan Commission met on Thursday, May 27, 1999, at 7:00 P. M. at the <br />Mooresville Town Hall. <br /> <br />Commission members present were: President Joel Beebe, Alan Marshall, Mike Young, John <br />Ehrhart, and Andy Pygman. Commission members absent were: Vern Kimmel, Bill Abbott, <br />Tim Bennett, and Charles McGuire. Town Attorney Tim Currens was present. <br /> <br />Motion was made by Commissioner Pygman, second by Commissioner Marshall to approve the <br />April 22, 1999 minutes. Motion carried 5-0. <br /> <br />President Joel Beebe told the Commission that due to Vem Kimmel's illness he was appointing <br />Andy Pygrnan as Secretary in Mr. Kimmel's absence. Commission agreed. <br /> <br />First on the agenda, Jack Lawson, attorney for Miller's and Mike Fogerty, head of development <br />for Millers presented Miller's Merry Manor rezone from B-2 to R-3. The property is located <br />where the Eagles Lodge previously stood. This project to be constructed is for assisted living <br />units. The covenants on the plat will state: 40 units max, 30 units minimum and assisted living <br />only. The units will be one or two bedroom or studios. Mr. Fogerty said the resident is usually <br />70 years plus, independent, and wants privacy. The construction will be brick and vinyl. There <br />will be approximately 7 full time employees. This project is a private paid product-no <br />government funds available. A staffwill be on duty 24 hours a day. There is no stove in <br />idividual units. Motion was made by Commissioner Pygman, second by Commissioner Ehrhart <br />to recommend to Town Council to rezone to R-3 with restrictive covenants to go along with R-3 <br />and a 40 unit maximum assisted living only. Motion carried 5-0. <br /> <br />Next, Holloway & Assoc. presented the Arvin Hopkins property on Bridge Street rezone from <br />Agrie. to R-2. This property is located behind the Mooresville School Bus Garage and to the <br />east of NAPA. The Master Plan of 1992 says Industrial. Mr. Hopkins is wanting to put doubles <br />on the property. The lots would be at least 10,000 sq. ft. with 14,500 sq. ft. per double. <br />Probable 18 buildings with total of 36 traits. Commissioner Ehrhart said this would introduce <br />more vehicles on Bridge Street which was already heavily traveled. The master plan says <br />business or light industry with two residential areas preserved. Attorney Foley, speaking on <br />behalf of Myron Westenhoffer, 560 Bridge Street, told the Commission they oppose the rezone. <br />He said this was similar to a spot zoning situation, that it wasn't fair to the people who would be <br />living in these doubles. The backyard would be bus garage or creek. There would be more <br />children for school system and more people on the sewer system. Mr. Westenhoffer would like <br />to keep the area business or industrial. Tony Sweet of Harlan Drive told the Commission he <br />knew of only one rental property within '/: mile radius. Motion was made by Commissioner <br />Ehrhart, second by Commissioner Pygrnan to recommend to the Town Council to deny the <br />petition for rezone to R-2. Motion carried 5-0. <br /> <br /> <br />
