MOORESVILLE BOARD OF ZONING APPEALS <br />FINDINGS OF FACT <br /> FOR VARIANCE OF USE <br /> <br /> Pursuant to IC 36-7-4-918.4 the Mooresville Board of Zoning Appeals having heard the <br />variance filed by Danny Kan' requesting the following use: mini warehouse on approximately <br />39 acre tract now makes the following Finding of Fact pursuant to lC 36-74-918.4: <br /> <br /> 1. The approval would not be injurious to the public health, safety, morals, and general <br />welfare of the community. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />be affected in a substantially adverse manner due to the impact of this type of use adjoining <br />residential uses and based upon the evidence presented including the statement as to property <br />values submitted by the remonstrators. <br /> <br /> 3. The need for the variance does not arise from some a condition pecnliar to the <br />property involved with there being no evidence to establish some evidence showing any condition <br />peculiar to this particular parcel of ground. <br /> <br /> 4. The strict application of the terms of the Zoning Ordinance will not constitute an <br />unnecessary hardship if applied to the property for which the variance is sought with no evidence <br />establishing a financial hardship being presented or that this ground cannot be used as currently <br />zoned. <br /> <br /> 5. The approval does interfere substantially with the Comprehensive Plan adopted under <br />the 500 series of this Chapter, namely because this use is significantly out of character with <br />other uses in the area which are primarily agricultural and residential. <br /> <br /> Based upon the above Findings of Fact the requested variance was denied at the meeting <br />of December 18, 1996. <br /> <br />Vern Kimmel <br /> <br />D~ald Barry <br /> <br /> <br />
