the minutes and the original plat that was approved. Mr. Beikman stated that they just
had to follow the original covenants and restrictions that were recorded in Morgan
County which said that if a house had brick, it had to cover at least 65 percent of the front
and have at least an 8 foot wrap on the first floor, but they also said they could be waived
by the architectural committee at any time. Tim Currens stated that because the
Covenants did say that they could be changed at any time is why we made them put four
things on the plat that they had to commit to and could not change. Those four things
are: if a one-story house is less than 1800 square feet, it has to have a basement, there are
to be no slabs, no vinyl siding, and a two-story house must be at least 2,400 square feet.
Mr. Beikman said that is why when the plans came through with hardy plank, he issued a
permit on it. There was a letter from Cedar Run Limited to the homeowners association
of Section 1 of The Settlement stating that the homes built on the remaining lots in
Section I would have brick on them; however the house in question is not in Section 1.

Building Inspector, Joe Beikman reported 27 permits and 76 inspections.

Commissioner Ehrhart told the Commission that the man on Indianapolis Road was back
to selling cars on the street. Joe Beikman stated that he checked before the meeting and
there were two on the street that did have tags on them but were for sale. Tim Currens
said they would have to say that he was doing business to file something against him.
Commissioner Bryant stated that when the man came to the meeting before, he admitted
he was doing business but thought he could because he was only selling ten per year and
his wife was selling ten to avoid the State licensing requirements, but indicated that he
would stop. Tim Currens said we would have him come to another meeting and ifhe still
refuses to stop they will take the necessary action.

The meetings were scheduled to go back to the 7:00 p.m. starting time for the months of
April through October; however, the Commission discussed the starting time and decided
to keep the meetings at 6:00 p.m. for the entire year to simplify things and avoid
confusion with the filings and notices.

There being no further business to come before the Commission at this time, a motion to
adjourn the meeting was made by Commissioner Ehrhart, second by Commissioner
Brown. Motion carried 7-0.

The next meeting of the Mooresville Plan Commission will be on Thursday, April 28,
2005, beginning at 6:00 at the Mooresville Town Hall.
