MOORESVII,LE BOARD OF ZONING APPEALS <br /> MINUTES , <br /> JANUARY 9, 2003 <br /> <br />TheMooresville Board of Zoning Appeals met on Thursday, January 9, 2003, at 6:00 <br />P.M. at the Mooresville Town Hall. <br /> <br />Board members present were: Alan Kramer, Chairman, Chris Crouch, Jon Swisher, and <br />Don Barry. Mike Young was absent. Town Attorney Tim Currens was present. <br /> <br />Motion was made by Don Barry, second by Chris Crouch, to approve the minutes of the <br />December 12, 2002 meeting. Motion carded 4-0. <br /> <br />First on the agenda was the election of officers. Mr. Kramer asked for nomination for <br />Secretary. Motion to approve Chris Crouch for Secretary was made by Don Barry, <br />second by Jon Swisher. Motion carded 4-0. <br /> <br />Motion was made by Don Barry, second by Chris Crouch, to approve Jon Swisher as <br />Vice Chairman. Motion carried 4-0 <br /> <br />Motion was made by Jon Swisher, second by Don Barry, to approve Alan Kramer as <br />Chairman. Motion carried 4-0. <br /> <br />Next on the agenda was Ross Holloway, Hollowy & Associates, representing Jeff <br />Clinger; 6680 Vista View Ct., asking for a multiple variance to construct a second <br />dwelling at 136 W. South Street, which was a continuance for the December meeting. <br />Mr. Holloway introduced Mr. & Mrs. Jeff Clinger, their daughter and Mr. Michael <br />Lundy. Their daughter will be the one benefiting from the variance. The variance is the <br />preliminary steps for the division of lot located at 136 W. South Street, for the purpose of <br />construction of a second dwelling that will be accessed off of a paved alley on the north <br />side of the lot. He passed out five photos showing the surrounding properties. The lot to <br />the west known as lot 034 and lot 033, that lot has been previously divided and has two <br />dwelling on it. To the North lots 009 and 008 is a division of a previous lot and to the <br />east of these lots 012, 013 and 014 are division of lots. The area has a history of several <br />divisions of different lots. The lot to the west has been divided and is very similar <br />situation to what the Clinger's are proposing. The third sheet is a variance sketch <br />showing the location of the existing houses to the west, also the proposed size of the <br />house. They meet the rear sit back and the side Yard set backs, so their variance is in two <br />parts. One is for the front set back and the other is for variances for the lot sizes for the <br />minor platting. The south half will be about 4600 sq. ft. and the north half about 4500 sq. <br />ft. They are also proposing a 1320 sq. ft. home. The fourth sheet shows a drawing of the <br />1320 sq. ft. home they are proposing. The need for the variance arises from the fact that <br />the Clinger's daughter has some special needs that require that she lives in walking <br />distance to services and has a home that has special construction requirements, such as a <br />fire retention system and some areas that will meet her special needs.
