Someone asked what would stop him from doing other type of butchering? Mr. Currens
said this specific variance before the board is to operate a deer meat processing, in other
words it would be limited to that specific use and no other. In answer to who would
police this or any variance, which is granted, have certain restrictions if it is granted, and
this restriction would be enforced through this board in the event they were not being
followed. Say they would continue to operate in January, no that was not granted as part
of the variance and should not be going on. The Board would be responsible for
receiving the violations. Someone asked about animal parts being found all over the
neighborhood would that be part of requirement to the variance. Mr. Currens said that
would be up to the board to set what restrictions there would be and they can set
restriction of the hours of operation, all sorts of thing, or they can find it does not meet
the requirement and not grant it at all. Any issue they bring up like that if relevant
whether it is granted, or if it is granted whether there should be restrictions on those types
of things.

Mr. Kan' said to ease the concerns of the neighbors he has come up with some possible
restriction. One he would restrict the hours from 9:00 AM to 9:00 PM, a privacy fence
on the bank side of the property that joins with theirs, concerning the bones if everyone
kept their dogs tied up it would not be that big of a deal, but he knows he can not control
that, so the only thing he could do is to put a fence just around the dumpster itself to
enclose it. The six yard dumpster had lids on it. Mr. Crouch asked if the lids were
plastic and how tall was the dumpster, and Mr. Kan' said it was about four feet and the
lids were plastic. Mr. Barry said he could padlock the dumpster. Mr. Kart said the
padlocks were a good option for the fence, since he only needed the dumpster three
months anyway.

Mr. Robert Pennington, 10793 N Bethel Road, said he had been living out there for
almost twenty years and it is a real quite area and he is against business coming in.
Mr. Michael Jones, 10813 N Bethel Road, is opposed to any business coming into the
neighborhood. Variance helped to ease his mind, but he is against any variance change.

After reading the Facts of Finding for the variance use Mr. Kramer asked for a motion to
approve, disapprove or modify the petition.

Motion was made by Mr. Barry, second by Mr. Swisher, to deny the petition due to the
health issue. Motion carried 3-1.

Motion was made by Mr. Swisher, second by Mr. Barry, to adjourn. Motion carried 4-0.

The next meeting of the Board of Zoning Appeals will be Thursday, May 8, 2003 at 7:00
PM at the Mooresville Town Hall.

Alan Kramer, Chairman
