MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> SPECIAL EXCEPTION <br /> <br /> The Town of Mooresville, pursuant to the Petition for <br />Special Exception to all a church in a B-2 District filed by <br />Cedar Run, Ltd. was heard at the meeting of August 12, 2004 and <br />the Board proceeded the following Findings of Fact: <br /> <br /> 1. The establishment, maintenance or operation of the <br />Special Exception would not be detrimental to or endanger the <br />public health, safety, morals or general welfare of the community <br />and that this use is probably less of an impact than the Business <br />zoning. <br /> <br /> 2. The Special Exception will not be injurious to the use <br />and enjoyment of other properties in the immediate vicinity where <br />the purpose already permitted in that the church usage would <br />present less of an impact on the neighborhood than the existing <br />Business zoning. <br /> <br /> 3. The establishment of the Special Exception will not <br /> impede or substantially alter the normal and orderly development <br /> and improvement of the surrounding property for uses permitted in <br /> the District since most of this property is developed and this <br /> use is compatible. <br /> <br /> 4. Adequate utilities, access road, drainage and other <br /> necessary facilities have been or are being provided currently. <br /> 5. Adequate measures will be made to provide ingress and <br /> egress so designated as to minimize traffic congestion on the <br /> public roads and this will be less of an impact than the Business <br /> use. <br /> <br /> 6. The Special Exception is located in a District where <br /> such use is permitted and all other requirements in this <br /> Ordinance which are applicable to such Special Exception shall be <br /> met. <br /> Based upon the above Findings, the Mooresville Board of <br /> Zoning Appeals approves the ~ption this 12th <br /> day of August, 2004. <br /> Donald ~a~r9 ~__~ <br /> <br /> Alan Kramer <br /> <br /> <br />
