MOORESVILLE BOARD OF ZONING APPEALS <br /> MINUTES <br /> THURSDAY, OCTOBER 14, 2004 <br /> <br />The Mooresville Board of Zoning Appeals met on Thursday, October 14, 2004 at 7:00 P.M. at <br />the Mooresville Town Hall. <br /> <br />Board member present were: Chairman, Alan Kramer, Mike Young, Don Barry, Christopher <br />Crouch and Jon Swisher. There were no members absent. Town Attorney, Tim Currens was <br />present. <br /> <br />First on the agenda was Pamela Siddons requesting a variance for a law office at 202 W High <br />Street. Ms. Siddons stated she would be using the building as a private law office; she has <br />looked around Mooresville and feels this would be an excellent location for her office. There <br />are currently four parking spaces, so there will not be any need for parking on the street. She <br />feels with the growth in the Mooresville area there is a need for another attorney in the area. It <br />will not impede the traffic flow with the law office, because the traffic will not be increased. <br />There are adequate utilities, drainage and roads. She stated there are other small businesses <br />maintained in that region and she does not feel that the law office would be a hindrance. There <br />are no plans for structural change. Mr. Kramer asked if the board had any questions and Mr. <br />Young asked if the variance was allowed would it only pertain to the law office, so if she sold <br />the law office would the variance go with the office? Mr. Currens said it would not, it would go <br />with the person. <br /> <br /> A~er reading the fact of findings for a Variance for Use, Mr. Kxamer asked for a motion to <br /> approve or deny the variance. A motion was made by Christopher Crouch, second by Mike <br /> Young to approve a Variance of Use for Pamela Siddons at 202 W High Street to operate a law <br /> office. Motion carried $-0. <br /> Next was Holloway Engineering, representing Arvin Hopkins requesting a Special Exception for <br /> a car wash on Lot 3 of Hopkins Minor Plat on Bridge Street. Mr. Holloway said for a special <br /> exception it would be referred to the Plan Commission for the impact on the land use and master <br /> plan for the community. They are asking for a continuance until the November meeting so they <br /> would not have to send out new notices. Mr. Holloway said his client, Mr. Reed, would like to <br /> build a car wash on Lot 3 of Hopkins Minor Plat, just east of Casey's on Bridge Street. He said <br /> it would be five bays, three automatic and two self-serve. It is zoned B-3 and it meets all the <br /> requirements. He said it was away from the intersection so that trafficwon'Lbe an issue with <br /> ~ ir. <br /> the driveway. Mr. Barry asked if the driveway could be moved to the ~J~ side of the lot for <br /> better traffic control? Mr. Holloway said moving the driveway could be done. A motion was <br /> made by Don Barry, second by Mike Young to approve the continuance of the variance for a <br /> Special Exception for Lot 3 Hopkins Minor Plat on Bridge Street until November 18, 2004 and <br /> they will not have to refile or mail out new notices. Motion carried 5-0. <br /> Mr. Young said at the last Planning Commission meeting he had talked with Sandy Perry about <br /> the meetings in November and December. Last year the BZA and Plan Commission meetings <br /> were combined. Mr. Currens said that was true and this is normally a slow time of the year for <br /> <br /> <br />
