MOORESVILLE BOARD OF ZONING APPEALS <br /> MINUTES <br /> APRII J 8, 2004 <br /> <br />The Mooresville Board of Zoning Appeals met on April 8, 2004, 7:00 P.M., at the Mooresville <br />Town Hall. <br /> <br />Members present were: Christopher Crouch, Jon Swisher and Don Barry. Members Mike Young <br />and Alan Kramer were absent. Town Attorney Tim Currens was present. <br /> <br />Motion to approve the minutes of the March 11, 2004 meeting was made by Don Barry, second <br />by Jon Swisher. Motion carded 3-0. <br /> <br />First on the agenda was Holloway Engineering, Inc representing the New Life Community <br />Church requesting a variance of use and Karen & Gary Rogers requesting a variance of standard <br />for an 80-foot communication tower. Mr. Hollowy sent a letter requesting a continuance until <br />June l0th meeting for both variances, because he would be out of town. <br /> <br />Next on the agenda was Millard L David; 10022 Old State Road 67, requesting a variance of use <br />to operated a used car business that was tabled from the March meeting. Mr. David said he <br />would be selling used cars. Mr. Crouch asked about the external lighting and Mr. David said <br />there was six flood lights on the outside of the building. <br /> <br />Mr. Robert Ridgeway, 10039 N. David Lane, said he was concerned about the value of his <br />property being lowed with this business. He stated that he had talked to two realtors and they <br />said his property value would be affected. Mr. Swisher stated that he was concerned about the <br />property value and had talked with three realtors and he received mixed reviews. Some said the <br />property value might be affected and some said maybe not, because a lot of the area is industrial <br />and that the area is going industrial. Mr. Swisher said that his property might become more <br />valuable if the whole area becomes industrial. Mr. Ridgeway said that his bedroom window <br />faced this property and if the lights were left on all night they would shine in his window so this <br />would be a nuisance. The board said they could control the hours that the lights would'be on. <br />Mr. Currens asked Mr. David if there was any need to have the lights on after business hours. <br />Mr. David said they would not need to be on. <br /> <br />After the reading of the Facts-of-finding for variance of use Mr. Crouch asked for a motion to <br />approve or deny the variance. Motion was made by Don Barry, second by Jon Swisher, to <br />approve the variance of use for Millard L. David, 10022 Old State Road 67, to operate a used car <br />business with the following restrictions: <br /> 1. Restrict the number of vehicles stored outside to (20) twenty cars. <br /> 2. Restxict the sign size to 3-feet by 4-feet. <br /> 3. Restriction that no cars to be parked within (100) one hundred feet of adjoining property <br /> Owner or beyond present gravel parking lot. <br /> 4. Restrict hours no greater than 9 AM to 5 PM for business hours. 9 AM to 5 PM Monday <br /> thru Saturday. <br /> 5. No additional outside lighting, currently 6 flood lights outside and limited to business <br /> <br /> <br />
