MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> <br /> Pursuant to IC 36-7-4-918.5 the Mooresville Board of Zoning <br />Appeals having heard the variance filed by Marvin Cable, Family <br />Video Movie Club, 5 E. Harrison St. requesting the following <br />variance from development standards: set backs from 20' to 11.5' <br />square footage from 5,000 to 6,160 and signage with conditions <br />that there will be no adult videos and the sign will be located <br />near the center of the lot in the tenth (10th) parking spot facing <br />Indiana St. counting from the North, now makes the following <br />Finding of Fact pursuant to IC 36-7-4-918.5: <br /> <br /> 1. The approval will not be injurious to the public <br />health, safety, morals, and general welfare of the community for <br />the following reasons: this has been used for commercial purposes <br />and none of the variances will impact the adjoining owners. <br /> <br /> 2. The use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner, for the reasons that: this is a commercial area <br />and should have no impact. <br /> <br /> 3.
