BOARD OF ZONING APPEALS <br /> THURSDAY, NOVEMBER 18, 2004, 6:00 P. M. <br /> MINUTES <br /> <br />The Board of Zoning Appeals met on Thursday, November 18, 2004, at 6:00 P. M. at the <br />Mooresville Town Hall. <br /> <br />Board members present were: Alan Kramer, Don Barry, Mike Young, Chris Crouch, and <br />Jon Swisher. No members were absent. Town attorney Tim Currens was absent. <br /> <br />A motion was made by Don Barry with a second by Jon Swisher to approve the minutes <br />of October 14, 2004 meeting with a change in the fiffia paragraph of the word west to <br />east. Motion carded unanimously. <br /> <br />A motion was made by Don Barry with a second by Jon Swisher to continue Don Fischer <br />DDS-118 North Indiana Street-a variance for parking to the December 16, 2004 meeting. <br />Motion carried unanimously. <br /> <br />Appearing before the board was Ross Holloway representing Hopkins and Chris and <br />Sherry Reid for a Special Exception for a Car Wash on Bridge Street located down from <br />Casey's. The property is zoned correctly at a B-3, which allows a carwash by special <br />exception. There will be three self-service bays and two automatic bays. The new <br />drawing shows the driveway to the east. This special exception request had come back <br />from the Plan Commission with a favorable vote. The board read from page 67 of their <br />book the findings of fact for a Special Exception. A motion was made by Don Barry with <br />a second by Jon Swisher to grant the Special Exception. Motion carded 5-0. <br /> <br />Next, Ross Holloway representing Charles Patton requested a change of use variance for <br />330 Bolton Avenue. This property is an investment property for Charles Patton. A few <br />of the units have been changed into storage units and one other unit rented as an <br />apartment. Kenny McClaren spoke saying he had grown up around Mooresville and had <br />input with Mr. Patton on this area as he has worked with him for about a year on the <br />Bolton Avenue property. Last month the Plan Commission had received a complaint on <br />the property from Mark Taylor that the condition of the property was bad. A tarp on the <br />roof was shredding all over the neighborhood yards, etc. Mr. Holloway stated the <br />property is currently zoned I-1 and some businesses that could go there would be a car <br />wash, auto repair, auto sales, paint and body, motor home sales, parking garage, truck <br />freight terminal, or a wholesale produce terminal. The Plan Commission had said this <br />was not compatible. Mr. Holloway explained a variance of use had to be gotten first and <br />a variance from developmental standards before they could proceed with the other <br />variances. Mr. Patton wishes to demolish the building and build an eight-unit apartment <br />building with one-bedroom units, 16 feet by 32 feet each with seven off-street parking <br />spaces, maybe eight. Mr. Holloway told the commission if Mr. Patton couldn't get a <br />variance of use then he would go with I-1, but neither he nor Mr. Patton knew what <br />would go there. Mr. Holloway said it was economically viable for the investor to put in <br /> <br /> <br />
