the modular building next to the existing building and as far back and off of Bridge Street as
possible. The need a variance to maintain the twenty-foot separation between the buildings as
required by the building codes, setback on the alley, and setback from the property line that runs
across the middle of their two lots. The third part of the variance has to do with parking spaces.
The have since the beginning used parking along the perimeter of their lots and they realize that
those parking spaces are more on town right-of-way than on their property. They propose to put
in ten parking spaces next to the new modular building. Mr. Crouch asked what the building
was made of and Mr. White said it was part brick and part vinyl siding. Mr. Crouch asked if the
new building would be on a block crawl space and Mr. White said it would be on block columns,
there is about twelve ten foot column with skirting that goes around them. Mr. White said they
would be strapping the building down according to code. Mr. Crouch asked what was across the
alley and Mr. White answered there was a block building, homes and garages. Mr. Crouch
asked if the siding would be four inch lap siding and Mr. White said it would be the same size
that is on houses and beige in color like the existing building.

Mr. Kramer asked if there were any questions from the audience and Mr. Mark Hurter, 203
Taylor Street, stated that his major concern as the Church get bigger is the parking. He was
wondering, as the church gets bigger where the people will park. Will they be parking along the
roads or people's yards. Mr. White stated that when the church grew to large to need more
parking than they had now, their long-term plans were to relocate. Mr. Swisher asked if they
had any plans for additional services and he said that was something they would consider when
they got to that growth stage. He said they would keep within their parking limitation and he
would not want people parking along the street in front of the neighbors homes.

After reading the Facts-of Findings for variance from developmental standards, Mr. Kramer
asked for a motion to approve or deny the variance.

Motion to approve the Variance of Developmental Standards for the setbacks of the rear yard
from thirty feet to thirteen feet was made by Mr. Don Barry, second by Mr. Christopher Crouch.
Motion carried 4-0.

Next Mr. Brown returned with a power of attorney and Mr. Kramer looked at the power of
attorney and stated that it was in order so they could continue with their petition for a variance of
use. Mr. Brown said they had asked a small two by three sign, set back twenty-five feet and he
was told that was in the limitations of the ordinance. Mr. Barry said he was correct. Mr. Brown
said that after a survey was done, they would like to extend the driveway to accommodate two
cars width. Mr. Crouch asked if they were going to live in the home and Mr. Brown said they
were not planning on living there, but the reason for the asking for a variance and not a rezone
was in the future they may want to live there as a retirement home.

After reading the Fact-of-Finding for a variance of use he asked for a motion to approve or deny
Mr. Brown's petition. Motion to approve the variance of use for 370 W Carlisle Street, was
made by Mr. Jon Swisher, second by Christopher Crouch. Motion carried 4-0

The next meeting of the Mooresville Board of Zoning Appeals is March 11, 2004 at 6:00 P.M. at
the Mooresville Town Hall
