MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having heard the request for a variance filed <br />by Michael E. Cavanaugh and Sally J. Cavanaugh to build a 24' x 30' detached garage on the <br />real property located at 71 W. High St., Mooresville, Indiana, more particularly requesting a <br />modification of the rear set back for an accessory use from 20' to 10'; and the Mooresville <br />Board of Zoning Appeals having held a public meeting on the 19th day of June, 1996 now <br />makes the following Findings of Fact from the development standards of the Town of <br />Mooresville's Zoning Ordinance pursuant to lC 36-7-4-918.5: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals and general <br />welfare of the community and that there are similar uses in the area which make this reduction <br />in set back reasonable. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner in that other set backs are similar which should <br />not impact the adjoining property owners. <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance will result in practical <br />difficulties in the use of the properties due to the lot sizes in this area of Town. <br /> <br />A!!c.~ ~mer, Chairman <br /> <br /> <br />
