MOORESVILLE BOARD OF ZONING APPEALS <br /> FilNDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having heard the variance request of Best <br />Homes, Inc. on the real property located on State Road 144 in the Northeast Quarter of Section <br />6, Township 13 North, Range 2 East, Brown Township, Morgan County, Indiana, more <br />particularly described in the attached Exhibit ~A", which is attached hereto and made a part <br />hereof, requesting a variance for placement maintenance of an advertising sign; and the <br />Mooresville Board of Zoning Appeals having held a public hearing on February 21, 1996, now <br />makes the following Findings of Fact pursuant to IC 36-7-4-918.4 and 918.5: <br /> <br />I. Concerning the variance request, the variance from the use standard to allow an advertising <br />sign in R Residential District: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals and general <br />welfare of the community with the location on a state road and the intentional sign for directional <br />purposes. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner due to the location on a state highway. <br /> <br /> 3. The need for the variance arises from some condition peculiar to the property <br />involved; the location adjoining a state highway. <br /> <br /> 4. The strict application of the terms of the Zoning Ordinance will constitute an <br />unnecessary hardship if applied to the property for which the variance is sought in that it is <br />adjoining a state road where locational maps are needed. <br /> <br /> 5. The approval does not interfere substantially with the comprehensive plan adopted <br />under the 500 series of this Chapter due to the location on a state road. <br />II. Variance from development standards to allow a sign within 500 feet of a residential use or <br /> <br /> <br />
