MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having heard the variance request of Timothy <br />R. Dunn and Tammy S. Dunn on the real property located at 2141 Rooker Rd. requesting a <br />variance to allow two (2) principal residence on one parcel; and the Mooresville Board of <br />Zoning Appeals having held a public hearing on the 21st day of February, 1996 now proceeds <br />to make the following Findings of Fact pursuant to lC 36-7-4-918.5: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals and general <br />welfare of the community due to the size of the lot and the other ordinance requirements being <br />met. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />be affected in a substantially adverse manner in that this use would affect the property values <br />of adjoining property owners by having two (2) primary residence on the lot. <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance will result in practical <br />difficulties in the use of the property. <br /> <br /> The Board of Zoning Appeals finding that the requirement under IC 36-7-4-918.5 are not <br />met now denies the zoning request. <br /> <br />Allen Cramer, Chairman <br /> <br />Vern Kimmel, Secretary <br /> <br /> <br />
