MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having heard the variance request of Phoenix <br />Property, Inc. to allow the use aa a real estate office on property zoned I-2, namely Lot 4 of the <br />Rawlings Minor Plat; and a public hearing having been held on the 17th day of January, 1996; <br />the Mooresville Board of Zoning Appeals now makes the following Findings of Fact pursuant <br />to IC 36-7-4-918.4: <br /> <br /> 1. That the approval will not be injurious to the public health, safety, morals and general <br />welfare of the community with the location of this use in an industrial setting not being <br />inconsistent with other office types used in the area. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner with other types of office uses being maintained <br />in the industrial setting and the use being inside of the building. <br /> <br /> 3. The need for the variance arises from some condition peculiar to the property <br />involved in that the property is zoned for industrial uses but has office types of uses present and <br />surrounding ground that is undeveloped making it ideal for an on site real estate location for the <br />strict application of the terms of the Zoning Ordinance will constitute an unnecessary hardship <br />if applied to the property for which the variance is sought due to the location of the property, <br />the undeveloped character of the property and surrounding uses. <br /> <br /> 4. The approval does not interfere substantially with the Comprehensive Plan adopted <br />under the 500 series of Indiana Code in that the office use within the building is similar to other <br />office uses in the area. <br /> <br /> 5. This variance request is subject to the approval of the Rawlings Minor Plat by the <br />Mooresville Plan Commission. <br /> <br /> <br />
