MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having heard the variance request of Ruth <br />O'Dell on the real property located at 241 High St., Mooresville, Indiana more particularly <br />described in the attached Exhibit "A~, which is attached hereto and made a part hereof, <br />requesting a use variance for an automobile sales lot south of the existing beauty shop salon; and <br />the Board of Zoning Appeals having held a public hearing on the 17th day of January, 1996 now <br />makes the following Findings of Fact pursuant to IC 36-7-4-918.4: <br /> <br /> 1. That the approval of the variance will not be injurious to the public health, safety, <br />morals and general welfare of the community due to the other commercial uses surrounding this <br />property. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner due to the other commercial uses in the area. <br /> <br /> 3. The need for the variance arises from some condition peculiar to the property <br />involved namely the depth of the land and the other adjoining commercial uses. <br /> <br /> 4. The strict application of the terms of the Zoning Ordinance will constitute an <br />unnecessary hardship if applied to the property for which the variance is sought in that the use <br />is not inconsistent yet the split zoning of the rear property would not represent a good use for <br />all of the ground to be opened up to. <br /> <br /> 5. The approval does not interfere substantially with the Comprehensive Plan adopted <br />under the 500 series of Indiana Code due to other commercial uses within the area. <br /> <br /> The Mooresville Board of Zoning Appeals now finds and grants the variance to the <br />petitioner to allow an automobile sales lot south of the existing beauty salon subject to the <br />restriction that all lighting shall be directed away from residential uses and all structures and <br /> <br /> <br />
