MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> Comes now the Mooresville Board of Zoning Appeals and pursuant to the evidence <br />presented at the public hearing held November 15, 1995 reviewed the petition filed by Harold <br />and Jane Lloyd residing at 1062 Keller Hill Rd., Mooresville, Indiana requesting a variance <br />from the width to depth ratio and the Board now makes the following Findings of Fact pursuant <br />to IC 36-7-4-918.5: <br /> <br /> 1. That the approval will not be injurious to the public health, safety, morals and general <br />welfare of the community due to the amount of land and nature of the topography of the land; <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner due to the lay out of the land and adjoining <br />areas; <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance would result in practical <br />difficulties in the use of the properties due to the topography and the depth of the ground. <br /> <br /> The Mooresville Board of Zoning Appeals now grants this variance request with the <br />stipulation by the petitioners that the variance request granted August 18, 1993 allowing a second <br />use of single family dwelling on Lot 1 shall terminate upon the sale of the primary residence at <br />Lot 1 or the granting of the building permit on Lot 2 of Lloyd's Minor Plat. <br /> <br /> PreSident u t <br /> o Secretary ~' <br /> <br /> <br />
