MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> Comes now the Mooresville Board of Zoning Appeals and pursuant to the evidence <br />presented at the public hearing held November 15, 1995 reviewed the petition filed by William <br />Wright and Margie Wright on Wright's Minor Plat requesting three (3) variances from the <br />development standards as follows: <br /> <br /> 1. The width to depth ratio on Lots 1 and 2; <br /> <br /> 2. The side building set backs on Lots 3 and 4; and, <br /> <br /> 3. The front building set back on Lot 4. <br /> <br />The Board now makes the following Findings of Fact pursuant to IC 36-7-4-918.5: <br /> Width to depth ratio <br /> <br /> 1. That the approval will not be injurious to the public health, safety, morals and general <br />welfare of the community due to the lay out of the Plat; <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner with these uses being compatible; <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance would result in practical <br />difficulties in the use of the properties without the granting of the variance based upon the lay <br />out of this land. <br /> <br /> Side building set backs on Lots 3 and 4 <br /> <br /> 1. That the approval of the variance from the development standards on the side set <br /> backs on Lots 3 and 4 of Wright's Minor Plat will not be injurious to the public health, safety, <br /> morals and general welfare of the community based upon the configuration of adjoining land <br /> uses and this property; <br /> <br /> <br />
