MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> Comes now the Mooresville Board of Zoning Appeals and pursuant to the evidence <br />presented at the public hearing of August 16, 1995 on the petition of Hoosier Energy for a <br />special exception to run ceftin power lines and substation now makes the following Findings <br />of Fact: <br /> <br /> 1. That the establishment, maintenance, or operation of this special exception will not <br />be detrimental to or endanger the public health, safety, morals or general welfare since this is <br />a necessary utility to provide power to an industrial area all of which is consistent with the <br />Master Plan and area. <br /> <br /> 2. The special exception will not be injurious to the use and enjoyment of other <br />properties in the immediate vicinity for the purposes already permitted in that this is a necessary <br />utility for the use and enjoyment of the adjoining areas and the proposed indus~al uses. <br /> <br /> 3. That the establishment of the special exception will not impede or substantially alter <br />the normal and orderly development and improvement of surrounding property for uses <br />permitted in the district in that this is a necessary utility and need for the uses permitted in the <br />district. <br /> <br /> 4. Adequate utilities, access roads, drainage and other necessary facilities have been or <br />are being provided; that the infrastructure provided here will be through the power lines and <br />some underground runs all of which are appropriate. <br /> <br /> 5. Adequate measures have been or will be taken to provide ingress and egress so <br />designated as to minimize traffic congestion on the public roads; that in this instance the only <br />traffic will be for installation, repair and maintenance none of which should create any <br /> <br /> <br />
