HOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the <br />variance request filed by Reverend William Wright who requested a <br />variance from the development standards for a Planned Unit <br />Development from a minimum of 3 acres to 2.6 acres on the property <br />located at SR 144 and Rooker Rd. The Mooresville Board of Zoning <br />Appeals having reviewed the Petition and held a Public Hearing the <br />9th day of July, 1995 now makes the following Findings of Fact <br /> <br />pursuant to IC 36-7-4-918.5: <br /> <br /> 1. That the approval will not be injurious to the public <br />health, safety, morals and general welfare of the community by <br /> <br />allowing the filing of the PUD on this area since it is consistent <br />with the type of use of the ground and purpose of the Planned Unit <br />Development portion of the Mooresville Zoning Ordinance. <br /> <br /> 2. The use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner in that it could be developed without the use of a <br />PUD and in fact would not be affected by the use of a Planned Unit <br />Development. <br /> <br /> 3. The strict application of the terms of the Zoning <br />Ordinance will result in practical difficulties in the use of the <br />property due to the proximity of this ground to other uses and the <br />shape of the property. <br /> <br /> The Mooresville Board of Zoning Appeals now grants the <br />variance from the development standards allowing a Planned Unit <br />Development on this 2.6 acre tract of ground to be filed. <br /> <br /> <br />
