MOORESVIIJJE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the variance request filed by <br />Roger L. Park of Park Engineering on the real property located at 203 Landersdale Rd., <br />Mooresville, IN recorded in Plat Book 188 Page 269 in the Office of the Recorder of Morgan <br />County, Indiana for the purpose of a variance from the development standards considering the <br />minimum lot width and minimum lot size required and the minimum lot size without sanitary <br />sewers on real property zoned for agricultural use. And the Board having held a Public Hearing <br />the 19th day of July, 1995 now makes the following Findings of Fact pursuant to IC 36-7-4- <br />918.5: <br /> <br /> 1. That the approval will not be injurious to the public health, safety, morals, and <br />general welfare of the community due to this being existing properties with homes already built <br />prior to the passage of the Ordinance. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance will <br />not be affected in a substantially adverse manner due to the fact that this use currently exists. <br /> <br /> 3. The strict application of the terms of this zoning ordinance will result in practical <br />difficulties in use of the property in making it very difficult to divide and sell the property. <br /> <br /> The Board of Zoning Appeals now grants the variance requested namely the minimum <br /> lot width to depth ratio and the minimum lot size without sanitary sewers from 43,500 square <br /> feet to 29,276.36 square feet with a further finding that there is an existing septic field which <br /> shall be included with each separate residence in the Minor Plat or accommodations made for <br /> this. <br /> <br /> It is also noted and made a part of this variance that the Petitioner volunteers to have <br /> <br /> <br />
