MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the variance request of <br />Robert Bingham for the real property at 124 E. High St. to reduce the set back for sign on the <br />side from 50' to 3' (illuminated sign). <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the Petition of Robert <br />Bingham at a public hearing held the 19th day of April, 1995 now makes the following Findings <br />of Fact pursuant to IC 36-7-4-918.5: <br /> <br /> 1. That the approval of the variance will not be injurious to the public health, safety, <br />morals and general welfare of the community with the similar business uses being present and <br />a current sign which is more intrusive. <br /> <br /> 2. That the use and value of the area adjacent to the property included in the variance <br />will not be affected in any substantially adverse manner due to the location of the sign and its <br />proximity to the building. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance will result in practical <br />difficulties in the use of the property due to other structures on the grounds and parking. <br /> <br /> The Mooresville Board of Zoning Appeals now grants the variance from development <br />standards under the Mooresville Zoning Ordinance subject to the following restrictions: <br /> <br /> 1. That the sign shall not be lighted or in any way illuminated beyond the hours of 7:00 <br />a.m. to 7:00 p.m. <br />2. That the existing sign in front shall be dismantled and abandoned on a permanent <br /> <br />basis. <br /> <br /> 3. That the sign shall be no greater than 8' x 6' and no higher than 12' at its base. <br /> <br /> <br />
