MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the variance request of <br />Joseph Lee and Doris Lee to place a 14' x 52' mobile home on a foundation on their two (2) <br />acre lot behind their home allowing two (2) primary residences on one (1) lot one (1) of which <br />is a mobile home. <br /> <br /> The Moeresville Board of Zoning Appeals having reviewed the Petition at a public <br />hearing and having heard evidence of thc parties and the public, the 19th day of April, 1995 now <br />makes the following Findings of Fact pursuant to lC 36-7-4-918.4: <br /> <br /> 1. That the approval of the variance will not be injurious to the public health, safety, <br />morals and general welfare of the community due to thc size of the lot and the location of the <br />mobile home. <br /> <br /> 2. That the use and value of the area adjacent to the property included in the variance <br />will not be affected in any substantially adverse manner due to the location of the mobile home <br />and the size of the lot. <br /> <br /> 3. That the need for the variance arises from some condition peculiar to the property <br />involved, namely the size of the lot. <br /> <br /> 4. That the strict application of the terms of the zoning ordinance will constitute an <br />unnecessary hardship if applied to the property for which the variance is sought due to the size <br />of the lot. <br /> <br /> 5. That the approval does not interfere substantially with the Comprehensive Plan <br />adopted under the 500 series of this chapter due to both uses being residential in nature. <br />The Mooresville Board of Zoning Appeals now grants the variance from use under the <br /> <br /> <br />
