MOORESVH,LE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the variance request of <br />Juanita Alumbangh for the real property located at 66 E. Main St., Mooresville, Indiana to allow <br />the home to be used as a double with one (1) portion of the double being the current residence <br />and the second portion being the garage area which shall be adjoined to the house with a closed <br />fire wall between the two (2). <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence at a public hearing held <br />the 19th day of April, 1995 and the Board of Zoning Appeals now makes the following Findings <br />of Fact pursuant to IC 36-7-4-918.4: <br /> <br /> 1. That the approval of the variance will not be injurious to the public health, safety, <br />morals and general welfare of the community due to other similar uses within the immediate area <br />and the use of existing structures. <br /> <br /> 2. That the use and value of the area adjacent to the property included in the variance <br />will not be affected in any substantially adverse manner due to the improvements which already <br />exist and the similar uses in the area. <br /> <br /> 3. That the need for the variance arises from some condition peculiar to the property <br />involved which includes the lot sizes and existing structure. <br /> <br /> 4. That the strict application of the terms of the zoning ordinance will constitute an <br />unnecessary hardship if applied to the property for which the variance is sought due to other <br />similar uses currently existing in the area. <br /> <br /> 5. That the approval does not interfere substantially with the Comprehensive Plan <br />adopted under the 500 series of this chapter due to the nature of the variance requested being <br /> <br /> <br />
