FINDINGS OF FACT <br />MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the variance request fried by Davis <br />Development, L.P. at its public hearing held November 16, 1994 requesting a variance to allow a temporary <br />advertising directional sign to be erected in a residential area with the dimensions being eight (8) feet by twelve <br />(12) feet and approximately ten (10) feet off the ground; and the Board having heard evidence now makes the <br />following findings of fact pursuant to Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance could be injurious to the public health, safety, and morals, <br /> <br />and general welfare of the community due to the location of the sign on State Road 144 and the past history <br />of accidents at this location. <br /> <br /> 2. That the use and value adjacent to the property included in the variance would not be affected <br /> <br />in a substantially adverse manner since there are other signs along this road. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance would not result in practical <br /> <br />difficulties in the use of this property and that it was not necessary for there to be a variance from the <br />development standards for using this ground. <br /> <br />Based upon the above F'mdlngs Of Fact, the requested variance was denied. <br /> <br /> MOORESVILLE BOARD OF ZONING APPEALS <br /> Donald Barry, Chin <br /> <br />/Vernon KTimmel, Secretax~ ~ <br /> <br /> <br />
