MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> Comes now Mooresville Partners, Inc. and petitions the Board <br />of Zoning Appeals for a variance from the Development Standards on <br />the placement of a sign for setback purposes pursuant to I.C. 36-7- <br />4-918.5. The Board of Zoning Appeals having heard the presentation <br />of the petitioner at a public hearing and all notices being in <br />order now proceeds the following Findings of Fact this 20th day of <br />July, 1994: <br /> <br /> 1. That the approval will not be injurious to the public <br />health, safety, morals, and general welfare of the community with <br />the sign setback being the same as other similar signs in the area; <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in any <br />substantially adverse manner since other signs in this commercial <br />area have similar setbacks. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance will result in practical difficulties in the use of this <br />property which would have the sign in the middle of an area making <br />it impracticable for use of the total property. <br /> <br /> THIS SETBACK VARIANCE GRANTED THIS 20TH DAY OF JULY, 1994. <br /> <br />Donald Ber~, Ch~IT'man ~ <br /> <br /> <br />
