MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> SPECIAL EXCEPTION <br /> <br /> Comes now Mooresville Partners, Inc., and Curtis Wilcher and <br />file their special exception for the use of this ground for an <br />automobile sales business with a body shop which are allowed by <br />special exception in a B-3 District, and the Board having received <br />a petition and appropriate notices, now proceeds the findings of <br />fact under the special exception procedures of Chapter 5 of the <br />Mooresville Zoning Ordinance with the following affirmative <br />Findings of Fact: <br /> <br /> 1. That the establishment, maintenance, or operation of the <br />automobile sales business and body shop would not be detrimental to <br />or endanger the public health, safety, morals, or general welfare <br />with the location of this business being off of a four lane highway <br />and in a commercial area. <br /> <br /> 2. That the special exception will not be injurious to the <br />use and enjoyment of other properties in the immediate vicinity of <br />the purposes already permitted in that this use should be <br />compatible with the adjoining area. <br /> <br /> 3. That the establishment of this special exception will not <br />impede or substantially alter the normal and orderly development <br />and improvement of the surrounding property for uses permitted in <br />the district with this area being commercial and on a four lane <br /> <br />highway. <br /> <br /> 4. That adequate utilities, <br />necessary facilities have been <br /> <br />access roads, drainage and other <br />or are being provided with the <br /> <br /> <br />
