BOARD OF ZONING APPEALS <br /> MINUTES <br /> JANUARY 12, 2012 <br /> The Town of Mooresville Board of Zoning Appeals met on January 12, 2012 at the <br /> Mooresville Government Center at 4 E. Harrison Street. <br /> Members present were Chairman,Neal Allman, Alan Kramer and Ann Whaley. Mike <br /> Young was absent. Town Attorney, Tim Currens was also present. <br /> The meeting was called to order by Chairman Allman. A motion to approve the minutes <br /> of the December, 2011 meeting was made by Ann Whaley and second by Alan Kramer. <br /> Motion carried 3-0. <br /> A-1 Expeditors was on the agenda requesting a variance for setbacks for a trailer at 1 <br /> Nice Pak Road. However since the filing, the setback had been changed from ten feet to <br /> 25 feet. Therefore, they were assuming the variance was no longer required. Attorney, <br /> Tim Currens suggested that the board continue this item so if for some reason the <br /> building inspector determined they were not in compliance they would not have waived <br /> any rights and would not have to refile. <br /> A motion to continue A-1 Expeditor's variance of development standards, if necessary, <br /> was made by Ann Whaley, second by Alan Kramer and carried 3-0. <br /> The next item on the agenda was Elizabeth Williams, representing Verizon Wireless for a <br /> Special Exception for a wireless communication facility. Elizabeth Williams was not <br /> present. <br /> A motion to continue the application of Verizon Wireless for a Special Exception was <br /> made by Ann Whaley and second by Alan Kramer. New notices will be required. <br /> Motion carried 3-0. <br /> The next item was Griffith Law Group representing John Schroeder and David Nowacki, <br /> owners of 400 Johnson Road for a variance of use for a small business office. The <br /> business has already been operating from this location for six years. The owners believed <br /> it was under Morgan County zoning and recently found out it was in the buffer zone. The <br /> home was built sometime around the seventies and had been in foreclosure. The current <br /> owners purchased the home and cleaned it up. The home is approximately 1400 square <br /> feet. The business is an import business of granite and tile from China. This office is <br /> used strictly for the purposes of paperwork. There are seven employees in the office <br /> including the two owners. The owners park in the garage. There is no signage and no <br /> traffic. There is additional parking for the other employees in front of the two garages. <br /> They have eight spaces including the garage and are required to have seven. Dale Dove <br /> of 233 Creekview Circle was concerned that if they go out of business something else <br />
