MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its reuglar scheduled <br />meeting on Wednesday, the 20th day of August, 1986 at the Mooresville Town <br /> <br />Hall. Present were Board Members Steve Oschman, Wendell Thaler, Tilford Bailey, <br />Donald Barry and Warren Franklin. The Board's Attorney, Timothy C. Currens was <br />also present. The meeting was called to order by Chairman Steve Oschman who <br />determined there was a quorum present. The Board then proceeded to approve the <br />minutes of the prior meeting and the findings of fact. The Board then proceeded <br />to the first item on the agenda, a petition for a variance from the development <br />standards filed by Larry W. Cooper and Rebecca S. Cooper of 204 East High Street, <br />Mooresville, Indiana. <br /> <br /> Attorney Currens advised the Board that the legal notices were in order <br />and the petitioners proceeded to explain their variance request. Larry Cooper <br />showed a drawing of their property and showed where they wanted to put in a <br />24' by 28' garage. The garage would be 8' from the back property line and the <br />Mooresville Zoning Ordinance requires a 40' set-back. Mr. Cooper showed how <br />the size of the lot was not sufficiently large to have the house and garage <br />and meet all of the set-backs in the front and rear. The Board then proceeded <br />to a discussion and specifically found that: <br /> <br /> 1. That the approval would not be injurious to the public health, <br /> safety, moral or general welfare of the community in that all of <br /> the lots in this area were small and that the overall coverage of <br /> improvements on the land was not such as to create any difficulties <br /> or threats to the public health or safety, morals or general welfare <br /> of the area. <br /> <br /> 2. That the use and value of the area adjacent to the property <br /> included in the variance would not be affected in a substantially <br /> adverse manner due to this being the size of most lots in this <br /> <br /> <br />
