MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly scheduled <br />meeting on Wednesday, the 16th day of July, 1986 at Mooresvil]e Town Hall. <br />Preaent were Board Members Steve Oschman= Warren Franklin, Tilford Bailey, <br />and Donald Barry. Standing in for Board Attorney, Timothy C. Currens, was <br />Attorney Michael A. Ksenak. The meeting was called to order by Chairman <br />Steve Oschman who determined there was a quorum present. The Board then <br />proceeded to approve the minutes of the prior meeting. The first item of <br />bus,ness was the petition of James M Fiscus and Franc~s Fiscals t~ operate <br />s day care center at 310 S. Clay Street in Mooresvi]le. Representing the <br />F~sc,ses was Attorney Dave Lawso,. <br /> <br /> Attorney Lawson advised that the Fiscuses had been operating ~ day <br /> <br />care center w~thout proper permits in Marleywood. There they had 10 children being <br />cared for and the petitioners at that time were not aware of the ordinance <br />requirements. The Fiscuses needed to expand and then moved to 310 S. Clay <br />Street where they have made significant improvements to the property. It was <br />at that time that they learned of the ordinance requirements and they immediately <br />filed the pending petition. <br /> <br /> Attorney Lawson advised that he did not feel this request would <br /> substantially affect the Master Plan in that there were other businesses in <br /> the area such as Newcomer Lumber, the rooming house, a beauty salon, and <br /> several rental properties. He indicated that this shows that there has already <br /> been a change in the area. Mr. Lawson also advised that in his opinion it would <br /> not be in the best interest of the area to rezone the property but felt merely <br /> that a variance would be sufficient. Francis Fiscus had talked to the neighbors <br /> and received no objection to the proposal. <br /> <br /> Attorney Lawson provided the Board pictures of the home. ~ indicated <br /> <br /> <br />
