MINUTES OF MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly called session <br />on Wednesday, the 21st day of March, 1984 at 7:00 o'clock P.M. at the Mooresville <br />Town Hall. Present were Board Members Steve Oschman, Warren Franklin, Wendell <br />Thaler, and Tilford Bailey. Also present was the Board's Attorney, Timothy C. <br />Currens. A determination of a quorum being present was made by Chairman Oschman <br />and minutes of the last meeting were approved as read by all members. <br /> <br /> Chairman Oschman then proceeded to the first item on the agenda, a petition <br />for a variance which had been carried over from the last meeting. The variance <br />filed by Shirley Christner under variance 1-1984 was to use the property located <br />at 116 South Indiana Street for a cormnercial sale and repair of hearing aid <br />equipment. A quorum vote was not given at the prior meeting and as a result <br />the matter was carried over to this meeting. Tom Kough proceeded to give a brief <br />surmnary of the evidence presented at the prior meeting including that this would <br />be a low traffic use and that no real objections were given by any of the <br />remonstrators at the prior meeting. Wendell Thaler then proceeded to make the <br />same motion given at the last meeting, that the variance be granted allowing <br />the variance for the commercial sale and repair of hearing and equipment with a <br />stipulation that if the garage was removed during the continuation of the business <br />on the premises that a privacy fence must be erected between the property and the <br />property at 11 W. Harrison Street. This was seconded by Tilford Bailey with two <br />members voting in favor of the variance being granted, one vote against, and one <br />abstention. The Board then entertained another motion. No further motion was <br />given and the matter again failed to receive a quorum vote for a granting or <br />denying the petition. The petitioner was given the option of carrying the matter <br /> <br />over for the next meeting. <br /> <br /> <br />
