MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly called <br /> <br />session on Wednesday, the 18th day of July, ]984, at 7:00 o'clock P.M. at the <br />Mooresville To~ Hall- Present were Board Members Steve O~chman, Pawl Walters, <br />and Warren Franklin. The Board's Attorneys Timotby C. Currens wes also present. <br />A determination of a quorum was made by Chairman Oschman and minotes of the last <br />meeting along with Findings of Facts were approved as read by all members. <br />Chairman Oschman then proceeded to the first item on the agenda, an application <br />for a variance filed by Nancy Harris of 59 S~ Clay Street, requesting a variamce <br />of the rear set-back from 40 feet to 14 feet and the side set-back from 12 feet <br />to t0 feet. Mrs. Harris was present in person and with her hnsband, Steven L. <br />Harris° She stated that the request for a variance was to put io an in-gro~nd <br />swimming pool and that it would surrounded by a fenced area. The existing house <br />had a set-back in the rear of 8 feet 2 inches a~d the side house had a side <br />set-back of 10 feet, w~th the swimming pool being within the perimeters of both <br />of these. The surrounding areas were all pointed oot to the Board and a drawing <br />was presented showing the location of the pool. Chairman Oschman then opened <br />the meeting up to questions from the floor. No one was present to remonstrate. <br /> <br /> The Board then entertained a motion which was made by Paul Walters to grant <br /> the variance from the development standards on the rear yard set-back from 40 feet <br /> to 14 feet and the side set-back from 12 feet to l0 feet. Warren Franklin seconded <br /> the motion and it unanimously c~rr~ed. <br /> <br /> There being no further b~sines~ to come before the Board the ~eeting upon <br /> motion duly made and seconded was unanimously adjouroed. <br /> <br />Warren Franklin, Secretary <br /> <br />Steve Oscb~nan, Chairman <br /> <br /> <br />
