MOORESX, qL/E BOA1LD OF ZONING APPEALS <br /> Wednesday, July 19, 2000 <br /> <br />The Mooresville Board of Zoniug Appeals met on Wednesday July 19, 2000 for their repJlar meeting. Board <br />Members present were Alan Kramer. Mike Yonng, Donald Barpt and JeffJustus. To~a~ attorney, Tim Cut~-ens, <br />was also present <br /> <br />Chaitman I~amer opened the meeting and asked t:or a motion on the minutes Ibr the June 21, 2000 Meeting. Don <br />Bat-pi motioned to accept the minutes as written, the second came from JeffJustus the motion can't'led 4-0 with <br />none opposed. <br /> <br />The first item on the agenda was Ross Holloway ~¥r Stewat~ O'Dell asking fat a variance in rem yard setback <br />fi'om 40 feet to 10 t~et. Bet~re having Mr. Holioway present flxe request Chairman IG'amer read a letter from <br />Joseph E Biekman, Building Official stating the vat'iance is strictly for zoning proposes and has no bearing <br />on what is required by the State Building Code..&~d that wonld include a 20' separatwn fi'om the property hne <br />or the installation ora required fire wall. Mr. Holloway said this w~ understood. At this time 3&. Holloway <br />presented the petition as a var'lance in rem- yard setback for t-1 Disl~ict adjoining a residential district from 40'to <br />10' and variance in the butt'er requirements for I-1 Dis~ict adjoitfing a residential district from 30' ti 10' <br />or the properly located at 141 East Hi_oh Street Mr. Holloway explained, That the Set Back ordinance hinders <br />the usage of the building of the proposed storage buildings. Nit-. Holloway had prepared pictures of adjoining lots. <br />Donald Bart'y asks what the side Set Back would be 3&-. Holloway stated it would be 10'. At this time Chairman <br />Kran~er read Findings of Facts for Variance from Development Standat'ds~ With no other questions Mike Young <br />motioned to approve the Variance with the understanding that they will meet State Codes. JeffJustus seconded the <br />motion, motion passed 4-0 with none opposed_ <br /> <br />Richard Jones of Valley Motors 1640 Karen Drive presented his petition for a reduced setback frmn 10~ to 3.5 <br />to build outo an existing building to expand his business. The building will be 30'x g0'. Donald Barpi asks if the <br />pr~erty backed up ~ainst the Men'ima~ property. Mr. Jones satd that yes it did. Witt~ no other questious The <br />Facts of Findings were read, with a motion being made by Donald Bat-pi to grant the petition as requested. The <br />second was from JeffJustus, motion carried 4-0 with none opposed. <br /> <br /> The next item was D & R Propetlies requesting a variance to build a larger residence than normally aiio,~ved i~r <br /> lot size. The property is 436 East Carlisle Street. The request would allow an R-2 building to be built on 6,800 <br /> square l~et instead of the required 10,000. The dwelling._ will be 1,800 square feet edxd a single s4opi with <br /> entrance from the from and back of the building._, tlfis would fit in with other hon~es in the area~ With no questions <br /> Chairman Kratner read the Facts of Findings for a variance from Developmental standards. Mike Young motioned <br /> *o approve the variance as requested with the second being from jeffJustus. The Motion cat-ried 4-0 with notre <br />.~,pposed <br /> <br /> <br />
